Terms of Service

Welcome to Edumate, an educational mobile application provided by Mubashir ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of Edumate, including its features, content, and services (collectively, the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By using Edumate, you confirm that you are at least 13 years old (or have parental consent if under 13, per COPPA) and agree to these Terms. We may update these Terms at any time, and changes will be effective 30 days after posting the revised Terms in the App or on our website edumate.mubashirpa.in . Your continued use of the App after changes indicates your acceptance of the updated Terms.

2. Eligibility

To use Edumate, you must:

• Be at least 13 years old or have parental consent.

• Not be located in a country subject to U.S. sanctions or prohibited by law.

• Comply with these Terms and all applicable laws.

3. Account Registration

You may need to create an account to access certain features (e.g., chats, quizzes). You agree to:

• Provide accurate information during registration.

• Keep your password secure and not share it with others.

• Notify us immediately of unauthorized account access at mubashirpa2002@gmail.com. We reserve the right to suspend or terminate accounts that violate these Terms.

4. License to Use

We grant you a non-exclusive, non-transferable, revocable, limited license to use Edumate for personal, non-commercial educational purposes, subject to these Terms. You may not:

• Copy, modify, or distribute the App’s code or content.

• Reverse-engineer or attempt to extract the App’s source code.

• Use the App for commercial purposes without our written consent.

5. User Content

Edumate allows you to create and share content, such as chat messages, notes, quiz answers, and uploaded files (photos, videos, audio, documents) ("User Content"). You:

• Retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute it to provide and improve the App (e.g., sharing messages in class chats).

• Are responsible for ensuring your User Content complies with these Terms and applicable laws.

• Acknowledge that User Content shared in class chats may be visible to other users in the same class.

We may remove or moderate User Content that violates these Terms or is deemed inappropriate, without prior notice.

6. Prohibited Uses

You agree not to:

• Use the App for illegal or unauthorized purposes.

• Post or share User Content that is harassing, defamatory, obscene, or infringes on others’ rights (e.g., copyrighted material).

• Attempt to hack, disrupt, or overload the App’s servers.

• Collect data from other users without consent.

• Impersonate others or create misleading accounts.

• Use the App to send spam or unsolicited messages.

7. Intellectual Property

All content, designs, logos, and code in Edumate (excluding User Content) are owned by Mubashir or our licensors and are protected by copyright, trademark, and other laws. You may not use our intellectual property without written permission, except as allowed under these Terms.

8. Privacy

Your use of Edumate is subject to our Privacy Policy, which explains how we collect, use, and protect your data, including Personal Info, Messages, Files, and Approximate Location. By using the App, you consent to these practices.

9. Third-Party Services

Edumate uses third-party services (e.g., Firebase, Supabase, OneSignal, Google). These services are governed by their own terms and privacy policies, which we encourage you to review:

10. Payments

If Edumate offers premium features or subscriptions, payment terms will be outlined during checkout. You agree to pay all applicable fees and taxes via accepted payment methods. Subscriptions may auto-renew unless canceled before the renewal date. Contact mubashirpa2002@gmail.com for billing issues.

11. Termination

We may suspend or terminate your access to Edumate at our discretion, with or without notice, if you violate these Terms or engage in harmful behavior. You may terminate your account by following the instructions in the App or contacting mubashirpa2002@gmail.com. Upon termination:

• Your license to use the App ends.

• We may delete your User Content, subject to our Privacy Policy.

12. Limitation of Liability

To the fullest extent permitted by law, Mubashir and its affiliates are not liable for any indirect, incidental, or consequential damages arising from your use of Edumate, including loss of data, profits, or device damage. Our total liability is limited to the amount you paid us (if any) in the past 12 months. The App is provided “as is” without warranties of any kind.

13. Indemnification

You agree to indemnify and hold Mubashir harmless from any claims, losses, or damages arising from your use of Edumate, your User Content, or your violation of these Terms or applicable laws.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes will be resolved in the courts of Kerala, India.

15. Dispute Resolution

Any disputes arising from these Terms or your use of Edumate will be resolved through binding arbitration, conducted by Indian Council Of Arbitration under its rules. You waive the right to participate in class actions. Contact mubashirpa2002@gmail.com to initiate dispute resolution.

17. Miscellaneous

• Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and [Your Company Name].

• Severability: If any provision is found invalid, the remaining provisions remain in effect.

• Assignment: You may not assign these Terms without our consent; we may assign them freely.
